This privacy policy (“Privacy Policy”) explains the data protection practices of Mehery Soccom Pvt Ltd a company registered in India under the Companies Act, 1956 as amended from time to time having its registered office at 1-34 A H Wadia Baug, Parel Tank Road, Mumbai, India. Where we refer to “OA” or “us” or “we” or “our”, we mean Mehery Soccom Pvt Ltd using your data in accordance with this Privacy Policy.
Please do not engage in any of the services rendered by us if you do not agree with the terms of this Privacy Policy.
If you live outside the European Region, we provide our services to you under this Privacy Policy. This service is not available to people residing in European Region and should NOT be used by people in the European Region.
Our Privacy Policy talks about what information we collect and how this affects you. It also explains the steps we take to protect your privacy.
This Privacy Policy applies to all of our services unless specified otherwise.
Information We Collect
Contact information: We collect your mobile phone number to operate, provide, improve, understand, customize, support and market our services, including when you install, access, or use our services.
Device information: We collect information about the device you use to access our services, such as the device type, operating system, and device ID.
Location information: We collect your location information when required to be used as a security measure.
Transaction information: We collect information about the activities you do on the app for our audit purposes only. It is explicitly clarified that no content/information you receive or send to any other third-party companies you interact with, through our app is collected by us.
The types of information we receive and collect depend on how you use our Services. We require certain information to deliver our Services and without this we will not be able to provide our Services to you.
Who provides us with your personal data?
Your Account Information. You must provide your mobile phone number to create an OA account. If you don’t provide us with this information, you will not be able to create an account to use our services. You can optionally add other information to your account, such as a profile picture, email id, your name and “about” information. This information is stored on our servers but is not required for the purpose of communicating with third-parties. We will not use this information to market or target any communication to you, on the app.
Your inbound Messages. We do not retain the messages sent to you, in the ordinary course of providing our Services to you. Instead, your messages are stored on your device and not typically stored on our servers. Once your messages are delivered, they are deleted from our servers. The following scenarios describe circumstances where we may store your messages in the course of delivering them:
o Undelivered Messages. If a message cannot be delivered immediately (for example, if you the recipient is offline), we keep the message in the encrypted form on our servers for up to 10 days as we try to deliver it. If a message is still undelivered after 10 days, we delete it.
o Private Media. When a business sends you user specific or private media (documents, image, videos), with or within a message, we do not store the media.
o Bulk Media. For promotional broadcast, the media is stored on our servers to aid in more efficient delivery of media only when it is broadcasted to a large number of the business’s user base.
End-to-end encryption We offer end-to-end encryption for our Services. End-to-end encryption means that messages directed to reach you, are encrypted at source and decrypted only on your device, to protect against us and third parties from reading them.
Your Connections. We do not access the phone numbers in your address book. When you use the feature of refer a friend, we will monitor the phone numbers referred, only to facilitate any promotion program we operate from time to time. If any of your contacts aren’t yet using our Services, we’ll manage this information for you in a way that ensures those contacts cannot be identified by us.
Customer Support and other Communications. When you contact us for customer support or otherwise communicate with us, you may provide us with information related to your use of our Services, including copies of your messages, any other information you deem helpful, and how to contact you (e.g., an email address). For example, you may send us an email with information relating to app performance or other issues.
Automatically Collected Information

Usage And Log Information. We collect information about your activity on our Services, like service-related, diagnostic, and performance information. This includes information about your activity (including how you use our Services, your Services settings, how you interact with others using our Services including when you interact with a business, and the time, frequency, and duration of your activities and interactions), log files, and diagnostic, crash, website, and performance logs and reports. This also includes information about when you registered to use our Services; the features you use like our messaging, profile photo, name, email id, “about” information; whether you are online, when you last used our Services; and when you last updated your “about” information.

Device And Connection Information. We collect device and connection-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, battery level, signal strength, app version, browser information, mobile network, connection information (including phone number, mobile operator or ISP),language and time zone, IP address, device operations information, and identifiers (including identifiers unique to OA associated with the same device or account).

Location Information. We collect and use precise location information from your device. There are certain settings relating to location-related information which you can find in your device settings or the in-app settings, such as location sharing. Even if you do not use our location-related features, we use IP addresses and other information like phone number area codes to estimate your general location (e.g., city and country). We may also use your location information for security, diagnostics and troubleshooting purposes.

Cookies. We use cookies to operate and provide our Services, including to provide our Services that are web-based, improve your experiences, understand how our Services are being used, and customize them.
Third-Party Information

Businesses On OA. Businesses that send you messages and information, using our Services, provide us only with your phone number.

User Blocks. You can block any businesses sending you messages by blocking either the OTP or Alerts or Promotion features or all features, at your discretion. When you block a business, we collect information on both the reporting user and reported business and pursue this with the reported business when such messages cross a certain threshold.

Third-Party Service Providers. We work with third-party service providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, if we are working with a third party that helps us collect feedback from the promotion campaign, you might be approached by them to provide information (if you agreed to this). You will be told clearly whether this information is collected anonymously or that your feedback is provided to us with information that allows us to identify you wherein the choice is with you. You are then informed about this by this third party (or they inform you together with us). They are responsible for ensuring that the data they provide to us is provided in compliance with applicable data protection law. Additionally, we may work with third parties to provide our technical and physical infrastructure, delivery, and other systems; provide engineering support, cybersecurity support, and operational support; supply location, map, and places information; help us understand how people use our Services; market our Services; help you connect with businesses using our Services; conduct surveys and research for us; ensure safety, security, and integrity; and help with customer service. These companies may provide us with information about you in certain circumstances; for example, app stores may provide us with reports to help us diagnose and fix service issues.

Protecting the privacy of children is important to us and for that reason, our services is structured specifically to not attract anyone under 18 years. If we learn or are notified that Personal information of Children has been collected, information from users under the age of 18, we will immediately delete such Personal Data. If you think that we have collected information from your children or children that are in your care, please contact legal@mehery.com. Further, while we prohibit registration by children under the age of 18, parents should, in such scenarios of children under the age of 18, supervise their children’s online activities and consider using parental control tools available from online services and software manufacturers that help provide a child-friendly online environment. These tools can also prevent children from disclosing online their name, address, and other personal details without parental permission. The term “parents” also includes legal guardians herein.
How We Use Information
We use information we have, subject to applicable law, to operate, provide, improve, understand, customize, support, and market our Services.

Our Services. We use information we have to operate and provide our Services, including providing customer support; improving, fixing, and customizing our Services. We also use information we have to understand how people use our Services; evaluate and improve our Services; research, develop, and test new services and features; and conduct troubleshooting activities. We also use your information to respond to you when you contact us.

Safety, Security, And Integrity. Safety, security, and integrity are an integral part of our Services. We use information we have to verify accounts and activity; combat harmful conduct; protect users against bad experiences and spam; and promote safety, security, and integrity on and off our Services.

No Third-Party Banner Ads. We do not allow third-party banner ads on our Services.

Business Interactions. We enable third parties, like businesses, to communicate and interact with you using our Services. Businesses may send you several types of messages which may include but not be limited to OTP’s; transaction information; appointment confirmations, updates and reminders; shipping notifications; product and service updates; and marketing.

We additionally use the information as follows:
o We use information to administer and fulfil our obligations under mandatory law including providing correct information to relevant authorities
o We use information to enable us to operate, administer access and use of the forums, websites, portals we provide to customers, resellers, developers and other user groups. This may include sending you services announcement (for instance, if our service is temporarily suspended for maintenance).
o We use information to enable us to administer, foster and develop your relationship with the use of a customer relationship management system
o We use information to enable us to fulfil its obligations in accordance with the contract between us and our customers, this may include sending you service announcements on elements included within the contract, customer service enquiries
o We use information to enable us to administer any consent/opt-out/opt-in that you may have given to us and/or send you emails such as newsletters etc.
Information You and We Share
You share your information as you use and communicate through our Services, and we share your information to help us operate, provide, improve, understand, customize, support, and market our Services.

Information Associated With Your Account. Your presence on OA, message delivery, read status, device specific information and geolocation, where required are shared with the business that has originated the message to you.

Businesses On OA. We offer specific services to businesses such as providing them with detailed metrics and message status reports, regarding their use of our Services.

Third-Party Services. When you or others use third-party services that are integrated with our Services, those third-party services may receive information about what you or others share with you. For example, if you use a data backup service integrated with our Services (like iCloud or Google Drive), they will receive information you share with them, such as your messages. Please note that when you use third-party services, their own terms and privacy policies will govern your use of those services and products.
Assignment, Change Of Control, And Transfer
As we continue to develop our business, by way of mergers/acquisition/reorganization/sale of assets etc., in such transactions, customer information generally is one of the transferred business assets but remains subject to express consent of the customer.
Managing And Retaining Your Information
We store information for as long as necessary for the purposes identified in this Privacy Policy, including to provide our Services or for other legitimate purposes, such as complying with legal obligations, enforcing and preventing violations of our Terms, or protecting or defending our rights, property, and users. The storage periods are determined on a case-by-case basis that depends on factors like the nature of the information, why it is collected and processed, relevant legal or operational retention needs, and legal obligations.
If you would like to further manage, change, limit, or delete your information, you can do that through the following tools:

Services Settings. You can use our “block” feature to manage the businesses who are allowed to communicate with you.

Changing Your Mobile Phone Number, Profile Name And Picture, And “About” Information. If you change your mobile phone number, you must update it using our in-app change number feature and transfer your account to your new mobile phone number. You can also change your profile name, profile picture, and “about” information at any time.

Deleting Your OA Account. You can delete your OA account at any time using our in-app delete my account feature. When you delete your OA account, any message targeted to be delivered to you, but not yet delivered will be deleted from our servers. Deleting your account will, delete that part of your information, which does not impact our necessity by regulation or prudence to store the past message logs. Your account info and profile photo and your OA message history on the mobile device will be deleted. Also, you will no longer be able to read the messages stored on iCloud / Google Drive. Be mindful that if you only delete OA App from your device without using our in-app “Delete my Account” feature, your backup on iCloud / Google Drive will be retained and can be transferred to another device.
Compliance with Laws and Law Enforcement
OA cooperates with mandated government and law enforcement agencies or to any third parties by an order under law for the time being in force to enforce and comply with the law of India. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process, to protect the property and rights of OA or a third party, to protect the safety of the public or any person, or to prevent or stop any illegal, unethical or legally actionable activity.
Our Global Operations
OA shares information globally, both internally within the OA and externally with our partners and service providers, and with those who communicate with you, from around the world, in accordance with this Privacy Policy. Your information may, for example, be transferred or transmitted to, or stored and processed in, India, UK, the United States; countries or territories where the OA Companies or affiliates and partners, or our service providers are located; or any other country or territory globally where our Services are provided outside of where you live for the purposes as described in this Privacy Policy. OA uses third party data centers. These transfers are necessary to provide the global Services set forth in our Terms. Please keep in mind that the countries or territories to which your information is transferred may have different privacy laws and protections than what you have in your home country or territory.
Updates To Our Policy
We may amend or update our Privacy Policy. We will provide you notice of amendments to this Privacy Policy, as appropriate, and update the “Last modified” date at the top of this Privacy Policy. Please review our Privacy Policy from time to time.

Disputes
Any dispute, controversy or claim directly or indirectly caused by, arising out of or relating to this Privacy Policy will be governed by the laws of India and will be referred to confidential, mandatory and binding arbitration in Mumbai, India. The arbitration will be conducted on an expedited basis before a single arbitrator appointed by Mehery Soccom Pvt Ltd in accordance with the provisions of the Indian Arbitration and Conciliation Act, 1996. The arbitrator’s award shall be substantiated in writing and will be final and binding on you and Mehery Soccom Pvt Ltd. Subject to the above, you agree to submit yourself to the exclusive jurisdiction of the Courts in Mumbai, India.
